Debt Management Credit Counseling Corp (dmcconline.org), a nonprofit charitable organization (“DMCC”), today announced that it has been approved by the U.S. Trustee office of the Department of Justice to provide bankruptcy certificates for both the pre-filing counseling and the pre-discharge debtor education that all consumers who file for bankruptcy protection are required to complete. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (Act) provides checks and balances to ensure consumers are making informed decisions when it comes to filing bankruptcy. Prior to filing for bankruptcy protection, the Act requires all Chapter 7 or 13 bankruptcy petitioners to participate in credit counseling and to provide the court a certificate of completion from a U.S Trustee approved nonprofit organization. The Act also requires all consumers who file for bankruptcy to provide a certificate evidencing completion of an approved personal financial management education course prior to having their debts discharged.
“Bankruptcy is a viable and necessary debt relief option for many U.S. consumers and we are pleased to be able to assist those in need” stated Phil Heinemann, DMCC Executive Director. The pre-filing counseling service is provided either in person at DMCC’s Deerfield Beach location or over the telephone. The bankruptcy counselingsession lasts about 60 minutes and costs $50 for both singles and couples. The bankruptcy education course is provided either in person at DMCC’s office or online. The Act requires that debtors spend at least two hours on the course, and it costs $25 for both single and couples. Unlike other providers, DMCC does not require consumers to pay the fees in advance of receiving the counseling or taking the education course. DMCC will also provide open accounts for attorneys who want to expedite the issuance of bankruptcy certificates for their clients. Both services are available in both English and Spanish.
